PRELIMINARY ARTICLE
MAISON MARCELLE JOAILLERIE, a simplified joint-stock company (société par actions simplifiée) with share capital of €40,000, whose registered office is located at 231 rue Saint-Honoré, 75001 Paris, France, is registered with the Paris Trade and Companies Register under number 929 621 944.

MAISON MARCELLE JOAILLERIE designs and sells jewelry under the MAISON MARCELLE brand. The company offers a selection of items for distance selling through its website at the following address: “www.maisonmarcelleparis.com”.
This English translation is provided for information purposes only. In the event of any discrepancy, the French version of these Terms and Conditions of Sale shall prevail.
ARTICLE 1: DEFINITIONS AND SCOPE OF APPLICATION
1.1 Definitions
The terms below, when capitalised, shall have the following meanings: “Items”: any product offered for sale on the Site.
“Order”: any request for Products placed and validated by the user on the site www.maisonmarcelleparis.com
“Terms and Conditions of Sale”: these terms and conditions of sale.
“Products”: the item(s) ordered by the Customer.
“Site”: the website www.maisonmarcelleparis.com.
“Company”: the company MAISON MARCELLE JOAILLERIE.
“Customer(s) or User(s)”: any person using the Site with the intention of ordering or purchasing Products offered by the Company.
1.2 Scope
These terms and conditions of sale govern all transactions concluded via the Site between the Company and end customers acting exclusively as consumers. They are reserved for consumers as defined by law and case law, acting on their own behalf.
These terms apply to all sales of Products made by MAISON MARCELLE JOAILLERIE via the site www.maisonmarcelleparis.com. Any order placed on the Site implies unreserved acceptance of these terms. When validating the order, the Customer must tick the box confirming that they have read the Terms and Conditions of Sale and fully accept them.
In accordance with article 1127-1 of the French Civil Code, these terms may be consulted, saved or printed by any User of the Site. MAISON MARCELLE JOAILLERIE reserves the right to modify them at any time. The applicable terms are those in force on the date the Order is validated.
This information complies with the legal obligations in force, in particular those of articles L.111-1 and L.111-2 of the French Consumer Code. The essential characteristics of the Products and their prices are available on the site “www.maisonmarcelleparis.com”.
These Terms and Conditions of Sale replace any earlier version, unless expressly stated otherwise. Validation of the order implies full acceptance of these terms. Acceptance is carried out by clicking the box provided for this purpose or the hyperlink. Without this acceptance, the ordering process cannot be completed.
Users are advised to read these terms carefully; they are available via a link at the bottom of each page of the Site. We recommend saving or printing them for reference. Any modification of the terms will not apply to orders validated before the changes come into force.
These Terms and Conditions of Sale will also be sent to you by email with your order confirmation.
ARTICLE 2: PRICE OF ITEMS
The price of the Products sold is the price in force and displayed on the Site on the date the order payment is validated. Prices are shown inclusive of all taxes.
The Site displays its prices in euros. The Customer may pay for their order in one of the currencies offered at checkout. The amount is then converted at the exchange rate applied by our payment provider, and displayed to the Customer before final validation of the Order.
Customs duties and import taxes payable are entirely borne by the Seller and included in the price shown.
The Company reserves the right to modify its prices at any time. However, Products will be invoiced on the basis of the rates in force on the date the order is paid.
ARTICLE 3: MEANS OF PAYMENT
Purchases made on the Site may be paid for by bank card (Visa, Mastercard, American Express), as well as by the other means of payment offered at checkout, including PayPal, Apple Pay and Shop Pay.
The available means of payment are displayed to the Customer when validating the Order and may vary according to the delivery country.
Any fraudulent use of a bank card belonging to a third party without their consent, or the contestation of a payment for fraudulent purposes, constitutes fraud under article 313-1 of the French Criminal Code. This offence is punishable by five years’ imprisonment and a fine of €375,000. Advanced technologies are used to detect and prevent attempted fraud.
For bank card payments, the Customer’s identity may be verified to ensure it matches the cardholder. In case of doubt, proof of identity may be requested by email or post.
ARTICLE 4: ORDERS
Orders placed on the Site are subject to the procedures described below.
4.1 Selecting Items
The Customer selects the items available for sale on the Site, together with the quantity they wish to acquire. Each item can be added to the basket by clicking the “Add to cart” button. For rings, bracelets and earrings, the Customer must select the desired size before adding the item to the basket. The basket does not in itself constitute an order binding on MAISON MARCELLE JOAILLERIE. Once the selection is complete, the Customer must confirm the contents of the basket and place the order.
4.2 Customer identification
Creating a customer account is not mandatory: the Customer may place an order as a guest, providing a valid email address and delivery details.
If the Customer already has an account, they log in with their email address and password. If they choose to create one, they provide accurate information such as their identity and contact details, together with a valid email address and a password. Once the account is registered, a confirmation email is sent to the Customer.
Login details and passwords are strictly personal, and each Customer undertakes to keep them secure and not to share them with third parties.
4.3 Order validation
Before final validation, the Customer may check the details of their order (total price, delivery method) and correct any errors. Any validated order entails an obligation to pay. To finalise the order, the Customer clicks “Proceed to payment”. Once the order is validated, MAISON MARCELLE JOAILLERIE acknowledges receipt by email. The order confirmation is sent once payment has been made. This document includes the order number, the total amount, delivery information and the characteristics of the items purchased. The Customer is advised to keep this confirmation in paper or electronic form.
4.4 Availability of Items
The items available for sale are those presented on the Site at the time of consultation.
Jewelry items, made to order in our Paris ateliers, require a production time of 4 to 6 weeks before delivery. MAISON MARCELLE JOAILLERIE reserves the right to withdraw items from sale at any time.
In the event of total or partial unavailability of an item after the order has been validated, the Customer will be informed by email. If the order is cancelled, a full refund will be issued within a maximum of fourteen days following cancellation.
ARTICLE 5: DELIVERY AND RECEIPT
5.1 General rules
Items will be delivered to the delivery address given by the Customer when ordering (the “Delivery address”). No delivery will be made to hotels, transit agencies, campuses, pick-up points or PO boxes. Delivery will only take place once the full amount of the Order has been received by MAISON MARCELLE JOAILLERIE. If payment is not validated, no delivery will be made.
Shipping is complimentary on every order, in France, within the European Union and internationally. Delivery terms are shown on the basket validation page and summarised before payment of the Order.
Customs duties, import taxes and customs formalities applicable to deliveries outside the European Union are borne by the Seller and included in the price shown. No additional amount will be requested from the Customer on delivery. Local sales taxes that may be due in certain United States jurisdictions are not included.
Products will be delivered to the address provided by the Customer. If several items are ordered, MAISON MARCELLE JOAILLERIE reserves the right to make separate deliveries at no additional cost to the Customer. Delivery will be initiated after payment verification.
5.2 Delivery methods
Items are shipped by MAISON MARCELLE JOAILLERIE’s carrier to the address indicated by the Customer, with delivery tracking and insured shipping. A tracking number is assigned to each order, and the Customer can follow their parcel using the link provided by the carrier.
Delivery delays may occur beyond our control, due to several factors: bespoke production, unforeseen circumstances, remote delivery areas, or traffic issues.
In the event of a delay or an inability to meet the delivery date or slot chosen by the Customer, MAISON MARCELLE JOAILLERIE will inform the Customer and offer to set a new date or slot, or to cancel the order with a full refund of the amount paid.
Deliveries are not made on Saturdays, Sundays or public holidays. Shipping is complimentary whatever the destination.
To ensure deadlines are met, the Customer must provide precise and complete information about the delivery address (street number, building, staircase, access codes, intercom, etc.).
The risks relating to the products are borne by MAISON MARCELLE JOAILLERIE until they are delivered to the address provided by the Customer. From that moment, the Customer becomes responsible for them.
ARTICLE 6: PROTECTION OF PERSONAL DATA
MAISON MARCELLE JOAILLERIE collects the Customer’s personal data and, where necessary, that of the recipient of the Order. The information requested is essential for processing orders and issuing invoices. It may be passed on to MAISON MARCELLE JOAILLERIE’s partners responsible for the execution, processing, management and payment of orders.
The processing of data transmitted via the Site complies with legal obligations regarding the protection of personal data, with an information system guaranteeing optimal security. MAISON MARCELLE JOAILLERIE undertakes to take all necessary measures to protect its customers’ personal information and orders.
In accordance with Regulation (EU) 2016/679 (GDPR) and French law no. 78-17 of 6 January 1978 as amended, the Customer has the right to access, rectify, erase, port, object to and restrict the processing of their personal data, as well as the right to give instructions concerning its fate after their death.
The detailed terms of collection, use, sharing and retention of data are described in our Privacy Policy, accessible from the footer of the Site.
To exercise these rights, the Customer writes to contact@maisonmarcelleparis.com. They also have the right to lodge a complaint with the CNIL, the French data protection authority (www.cnil.fr).
ARTICLE 7: RETENTION OF TITLE CLAUSE
The products remain the exclusive property of MAISON MARCELLE JOAILLERIE until the price has been paid in full, including the principal, fees, taxes and mandatory contributions.
ARTICLE 8: APPLICABLE LAW
This contract is governed by French law.
ARTICLE 9: INTELLECTUAL PROPERTY RIGHTS
Any use, even partial, of the Site (downloading, reproduction, transmission or representation) for purposes other than personal and non-commercial is prohibited. Any infringement exposes the author to the penalties provided for by the French Intellectual Property Code,
in particular for counterfeiting (articles L.335-1 et seq. for copyright, and L.716-1 et seq. for trademarks), as well as by the Civil Code in matters of civil liability (articles 1382 et seq.).
Likewise, copyrights, designs, models and patents remain the exclusive property of MAISON MARCELLE JOAILLERIE.
Creating hypertext links to a page or an element of the Site requires prior written authorisation from MAISON MARCELLE JOAILLERIE, which reserves the right to revoke it at any time. Sites containing links to the Site, or to which the Site may refer, are not under the control of MAISON MARCELLE JOAILLERIE, which declines all responsibility regarding their content or access.
ARTICLE 10: RIGHT OF WITHDRAWAL, RETURNS AND EXCHANGES
10.1 — Made-to-order pieces
MAISON MARCELLE JOAILLERIE creations are not held in stock. Every piece is made in our Paris workshops after the order is received, according to the specifications given by the Client at that time: metal, size and, where applicable, engraving.
In accordance with article L221-28 3° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts supplying goods made to the consumer’s specifications or clearly personalized. Made-to-order creations, and engraved pieces, are therefore excluded from the right of withdrawal.
The Client is informed of this on every product page and must expressly acknowledge it, by ticking the box provided, before confirming the order.
10.2 — Pieces not covered by this exclusion
For any piece not made to the Client’s specifications, the Client has fourteen (14) days from receipt of the order to exercise the right of withdrawal, without having to give reasons or bear any penalty, in accordance with articles L221-18 et seq. of the French Consumer Code.
The Client notifies this decision by an unambiguous statement sent to contact@maisonmarcelleparis.com, and returns the piece without undue delay and no later than fourteen (14) days after that notification.
In accordance with article L221-23 of the French Consumer Code, return costs are borne by the Client. The return must be made by insured shipment for the full value of the piece.
The piece must be returned complete, unworn, in its original packaging and with all documents provided. The Client may be held liable for any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the piece; the sum refunded is then reduced accordingly.
Reimbursement is made within fourteen (14) days of the notification. MAISON MARCELLE JOAILLERIE may withhold reimbursement until it has received the piece back, or until the Client has supplied proof of dispatch, whichever occurs first. Reimbursement is made using the same means of payment as the original order, unless the Client expressly agrees otherwise.
10.3 — Commercial exchange
Independently of the statutory provisions above, and as a gesture of goodwill, MAISON MARCELLE JOAILLERIE accepts the exchange of any creation, including made-to-order pieces, within thirty (30) days of receipt, whatever the delivery destination.
The piece must be unworn, complete and in its original packaging. Return costs remain payable by the Client. Where the exchange is for a creation of greater value, the difference is paid by the Client. This exchange may, at the Client’s option, take the form of a credit note valid for two (2) years across the whole collection.
This exchange facility is a commercial courtesy and shall not be construed as an extension of the statutory right of withdrawal.
10.4 — Resizing
Resizing of rings and bracelets is complimentary for life. Only outbound and return shipping costs remain payable by the Client.
10.5 — Statutory guarantees
Nothing in these terms deprives the Client of the statutory guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) or the guarantee against latent defects (articles 1641 et seq. of the French Civil Code), nor of the one (1) year commercial warranty granted by the Maison. Any piece with a manufacturing defect is taken back, repaired or replaced at no cost, return shipping included.
ARTICLE 11: GUARANTEES
Legal warranty of conformity and product defects:
In accordance with the law, MAISON MARCELLE JOAILLERIE is required to comply with the legal warranties of conformity of goods, as defined in article L217-4 of the French Consumer Code, as well as the warranty against hidden defects provided for by article 1641 of the Civil Code.
In the event of non-conformity of the product, the consumer has two years from the date of delivery to exercise their rights. They may choose between repair or replacement of the product, subject to the conditions set out in article L217-9 of the Consumer Code. During the twenty-four months following delivery, the customer is not required to prove the existence of the lack of conformity.
This legal warranty applies independently of any commercial warranty and of the warranty against hidden defects. Under article 1641 of the Civil Code, in the event of a hidden defect, the customer may request rescission of the sale or a price reduction, in accordance with article 1644 of the Civil Code.
Warranty against hidden defects:
The provisions of the Civil Code relating to hidden defects are as follows:
Article 1641: The seller is bound to warrant against hidden defects in the product that render it unfit for its intended use, or that so impair that use that the buyer would not have purchased it, or would have paid a lower price, had they known of them.
Article 1648, first paragraph: Legal action for hidden defects must be brought within two years of the discovery
of the defect.
Article 2232: The suspension, interruption or postponement of the limitation period may under no circumstances extend the limitation period beyond twenty years from the day the claim arose, save for the exceptions provided for in articles 2226, 2226-1, 2227, 2233 and 2236, and in articles 2241 and 2244 of the Civil Code. This rule does not apply to actions relating to personal status.
Maison Marcelle commercial warranty:
Independently of the legal warranties mentioned above, which remain fully applicable, MAISON MARCELLE JOAILLERIE grants a commercial warranty of one (1) year from the date of purchase, covering manufacturing defects only.
This warranty does not cover:
- normal wear related to time and to the use of the piece;
- scratches, deformation or damage resulting from impact, accident or improper use;
- damage caused by lack of care;
- any modification or repair carried out by an unauthorised third party;
- the loss of elements or stones resulting from an external cause.
For any request under this warranty, the Customer contacts customer service via the contact form on the Site, attaching proof of purchase. After examining the piece, the Maison will indicate the applicable coverage.
ARTICLE 12: COMPLAINTS AND INFORMATION
For any request for information, complaint or question concerning these Terms and Conditions of Sale or the products, Customers are invited to contact MAISON MARCELLE JOAILLERIE’s customer service via the contact form available on the Site, stating their order number where relevant.
